TERM AND CONDITION

Definition

  1. SIPERMIT shall be placement and recruitment service of Indonesian Migrant Worker in Malaysia by Indonesian Mission in Malaysia that can be accessed through Internet by using a web browser or an application downloaded on a mobile phone/computer tablet handset.
  2. Indonesia Placement Agency (IPA) shall be Indonesian Placement Agency that have licensed from Ministry of Manpower of Republic Indonesia including the branch offices.
  3. Malaysian Recruitment Agencies (MRA) shall be an entity that have license form Labour Department who has been registered as a User of “Sipermit” by Indonesian Mission service in Malaysia for recruit and placement of Indonesia Migrant Workers to the Employer in Malaysia in accordance the applicable of Indoensia Regulations
  4. Company shall be an entity that employ of Indonesian Migrant Workers and who has been registered as a User of “Sipermit” by Indonesian Mission service in Malaysia
  5. Username shall be an identity of each User that is used to log in to “Sipermit” by Indonesian Mission service in Malaysia.
  6. Password shall be the identity or secret code that is owned and used by the User to login to Sipermit” by Indonesian Mission service in Malaysia.
  7. Email Notification Service shall be a notification by Sipermit via email to the registered email address of User in connection with a certain service provided by Indonesian Mission in Malaysia

Sipermit Conditions of Use

  1. The User owns Sipermit account(s) and also owns a certificate registration by the Indonesian Mission in Malaysia to activate Sipermit service
  2. For registration, the User must provide valid, original identification and proof of ownership of the account and fill out and sign the supporting form or documents for registration of Sipermit by Indonesian Mission in Malaysia provided.
  3. Each entity who is have a branch should fill out the Application Form for Sipermit
  4. After registering, the User must do registration / activation of Sipermit by Indonesian Missin in Malysia service through the Registration / Activation page which is available on the web or application of Livin' by Mandiri by entering the registering the User email addres, and Password.
  5. After registration of Sipermit at the Registration / Activation page available on the web or application of Sipermit , the User Account has agreed to the terms and conditions of the applicable Sipermit by Indonesia Mission in Malaysia.

Sipermit Terms of Use

  1. The User Account may use Sipermit service to make request, recruit and placement of Indonesian Migrant Worker as registered and verified by Indonesian Mission in Malaysia
  2. If the User a specified period does not make any request or recruitment and placement process through Sipermit, the application or web will automatically logout and return to the login page.
  3. In each request or recruitment:
    • The User must ensure the accuracy and completeness of instruction (including making sure that all data and documents required for the process has been filled in completely and correctly). Indonesian Mission in Malaysia is not responsible for any effect whatsoever that may arise as a result of negligence, incompleteness, vagueness or inaccuracy in the instruction / data from the User.
    • The User has the opportunity to re-check or cancel the data that has been filled in when the confirmation is automatically carried out by the system before any approval or submitted.
    • If the User has made sure the accuracy and completeness of the data, as a sign of approval of the transaction, the User Customer must click the register or submit on the page of Sipermit service.
  4. All transactions that have been instructed to the Sipermit and approved by the User cannot be cancelled.
  5. All the data and documents has been provided by User, will be verified by the officer. If not complete or correct, will give notified through the system
  6. Each instruction that has been approved by the User Customer data stored on a data center of the Bank is the correct data received as proof of the User Customers instruction to the Bank to carry out the relevant transaction, unless the User Customer can prove otherwise.
  7. The User must inform the Indonesian Mission in Malaysia immediately if the account user receives data or information which is incomplete or incorrect through a branch office.
  8. Indonesia Mission in Malaysia has the right to not to carry out the instruction from the User, if:
    • Indonesian Mission in Malaysia knows or has a reason to suspect that a fraud or criminal act has been or will be committed.
    • there is incomplete fulfillment of requirements required by the Indonesia Mission in Malaysia to process the User.
    • based on the reasons and other considerations which are solely determined by the Indonesian Government, it is necessary not to carry out the transaction in order to protect the interests of the Indonesian Migrant Workers or account holder.
  9. All of the consequences arising from the misuse of Sipermit will be the responsibility of the User and the User hereby fully releases the Indonesian Mission in Malaysia from any claims that may arise due to the misuse and leakage of information in the form of User ID, Password and from any party whatsoever.
  10. As proof that the registered by the User r has been successfully carried out by the Sipermit, the User will receive or download certificate registration on the Sipermit history registration page.
  11. The User account agrees and acknowledges that:
    • For successful process through Sipermit, all instructions and communications from the User received by the Sipermit will be treated as valid proof although they are not made in a written document or there is no issuance of a signed document.
    • The proof of the instructions from the User to Indonesian Mission in Malaysia and all forms of communications between the Indonesian Mission in Malaysia and the User electronically sent and stored in the data center of the Indonesian MIssion in Malaysia and Ministry of Manpower in the form of written documents, records, tape/ cartridge, computer printout and/or copy, is valid proof the validity, correctness or authenticity of which cannot be disputed.
    • Company details such as name, address, office number and director of company or responsible person in company to publish in sipermit for recruiting information of Indonesian Migrant Workers
  12. At its sole discretion, Indonesian Mission in Malaysia has the right to terminate or freeze the account. The closing service will be binding on the User account through notice pursuant to the applicable provisions in Indonesia or Malaysia.
  13. All communications via e-mail are secure and meet the standards and are considered valid, authentic, genuine and correct and have the same effect as if they were made in writing or through a written document.
  14. Indonesia Mission in Malaysia is not obliged to carry out any instruction whether it is signed or not or to answer any question received via e-mail which is not secured. The User is advised not to send confidential information via e-mail which is not secure.
  15. Indonesia Mission in Malaysia has the right to suspend Sipermit service temporarily or for a certain period of time as determined by the Indonesia Mission in Malaysia for renewal, maintenance or for other purposes for reasons deemed good by Indonesia Mission in Malaysia, and for that, Indonesia Mission in Malaysia is not obliged to be accountable to anyone.
  16. The User hereby expresses the willingness to receive Email Notification Service or Feed Notification Service.
  17. The User must maintain the security of information received via Email Notification Service. All forms of misuse and leakage of information of Email Notification Service and/or Feed Notification Service received by the User is the responsibility of the User. The User hereby indemnifies Indonesian Mission in Malaysia against any claims that may arise, from other parties or the User as a result of misuse and leakage of information Email Notification Service, or Feed Notification Service.

Username and Password

  1. Password PIN and process authentication code are a confidential code which the User has the authority to use. User ID is fixed and cannot be changed.
  2. The User Account must secure Username, Password and transaction authentication code for Sipermit by
    • not disclosing User ID, Password and transaction authentication code for Sipermit to others.
    • not writing Username, Password and transaction authentication code on paper or storing it in writing or in other storage facilities that make them known by others.
    • carefully using Username, Password and transaction authentication code so they are not seen by others.
    • frequently changing the Password periodically.
  3. If the User enters the wrong Password. To reactivate Sipermit service, the User can use forgot password or has to come to Indonesian Mission in Malaysia office
  4. In the event that the User knows or suspects that Username, Password/ has been known by another person who is not authorized, or the device to receive/generate the transaction authentication code has been in the possession of another person who is not authorized, the User must immediately provide security by making changes to Password. If for some reason the User cannot change Password or the device to receive/generate the transaction authentication code has been in the possession of another person who is not authorized, the User Customer must notify the Indonesian Mission in Malaysia and request termination of access to Sipermit service. Prior to receipt of notification in writing by the authorized officer of the Indonesian Mission in Malaysia, all instructions, transactions and communications based on the use of Username, Password by an unauthorized person are entirely the responsibility of the User.
  5. The use of Username, Password has the same legal force as the written instruction signed by the User/Director, and so the User hereby represents that use of Username, Password in each instruction for transactions through Sipermit constitutes the authorization from the User to the Indonesian Mission in Malaysia to carry out process, including but not limited to, to freeze user's account for carrying out the process as instructed and for the recruitment process that have been or will be determined later by the Sipermit
  6. Any misuse of Username, Password for Sipermit is the responsibility of the User or Director. The User hereby indemnifies the Indonesian Mission in Malaysia against any claims that may arise, from other parties or the User Customer as a result of misuse of Username, Password for Sipermit

Termination of Access to Sipermit Service

  1. Access to online Sipermit service will be terminated by the Indonesian Mission in Malaysia if:
    • The User requests the Indonesian Mission in Malaysia to terminate access to online Sipermit service temporarily or permanently, which among other things is caused by:
    • The User forgot Username, Password
    • Username, Password are known by another person who is not authorized
    • The User breaking the Indonesia or Malaysia Regulations regarding Placement of Indonesian Migrant Workers
    • The Indonesia Mission in Malaysia carries out an obligation in accordance with the applicable laws and regulations.
  2. To reactivate the terminated access to the service stated above, the User may can re-open the service or do re-registration through Indonesian Mission in Malaysia Office.

Force Majeure

The User will indemnify the Indonesian Mission in Malaysia from all claims whatsoever, the Indonesian Mission in Malaysia k cannot carry out the instruction from the User either partially or wholly due to events or causes beyond the control of the Indonesian Mission in Malaysia including but not limited to any computer virus, troubled system, Trojan Horses or components which are harmful and can interfere with Sipermit service, Sipermit application, web browser or computer system of the Indonesian Mission in Malaysia, the User, or Internet Service Provider, due to natural disasters, war, riot, malfunction of equipment, system or transmission, electrical interference, telecommunication disruption, government policy, and other events or causes beyond the control of the Indonesian Mission in Malaysia. Others

  1. Indonesian Mission in Malaysia may amend these terms and conditions at any time with prior notice to the User r in any form and by any means.
  2. The User is subject to the regulations applicable to the Indonesian Mission in Malaysia k, including but not limited to the Indonesia and Malaysia Regulations.
  3. The authority expressed or implied in these Terms and Conditions shall constitute the valid authority that will continue so long as the User uses Sipermit service or the User has obligations to the Indonesian Mission in Malaysia.
